How to Deal With NYC Class B,C, and D mold violations
With the need to establish healthy living conditions being a
major concern of New York City Department of Health and Mental Hygiene (DOHMH),
there is need for New Yorkers to take mold violation seriously. This is because
mold has far-reaching catastrophic repercussions to the health individual, and
hence there is need for landlords to remediate this problem wherever it occurs.
Unfortunately, there are no specific legal procedures for
handling mold violation cases. According to the New York City Department of
Housing Preservation and Development (HPD), class C mold is considered to be a violation
of the New York City Housing Maintenance code, but under the provisions of the
code, it is stipulated that houses should be kept in good conditions without
explicit mention of the mold violations.
While the Alternative Enforcement Program is of great help,
more can be done. Under this program, Once HPD identifies a set of dwellings
under the under class B or class C hazardous violation of the Housing
Maintenance code, then the AEP is applied on the landlords of these dwellings. It
is important to note that participation in this program is not by choice. However,
the landlords in question can still be discharged from the EAP within the first
four months if they completely correct class C violations related to mold
within this period among other conditions.
In a nutshell, class C mold violations entail an immediately
hazardous problem that needs to be addressed urgently and stringently. For this
reason, the relevant authorities should come up with long-term solutions of
this problem as soon as possible. Incorporating the DOHMH mold assessment and
remediation guidelines into the New York City Housing Maintenance code could be
of great help. Stern action should also be taken against landlords who
willingly ignore a call to remediate the mold violation in their premises.
